1. Agreement to these terms
By creating an account, clicking acceptance controls, accessing TheraScope, or using any TheraScope feature, you agree to these Terms of Use and our Privacy Policy. If you use TheraScope for an organization, you represent you are authorized to bind that organization. If you do not accept these terms, you must stop using TheraScope.
2. Product scope and authorized users
TheraScope is intended only for authorized users managing administrative, clinical, and operational workflows for therapy practices and related organizations. You must be at least 18 years old and legally capable of entering into these terms. You remain responsible for ensuring that your use of TheraScope complies with your organization's policies and applicable law.
3. Accounts, administrators, and security
- You are responsible for protecting all login credentials and access methods for your account and any delegated users.
- You must provide accurate account information and keep it current.
- Organization administrators may configure users, roles, permissions, integrations, subscription settings, and workspace policies.
- You must notify us promptly if you suspect unauthorized access, account compromise, or security misuse.
- We may suspend or restrict access when we reasonably determine there is fraud, abuse, legal, or patient-safety risk.
4. Customer content and permissions
You retain ownership of patient, client, practice, billing, calendar, document, note, transcript, and related content that you or your users create, upload, or import through TheraScope. You grant TheraScope a limited, revocable, non-exclusive license to host, process, transmit, display, secure, and back up that content as necessary to provide and improve the service, subject to these terms, our Privacy Policy, and any signed agreement.
5. Professional responsibility and emergency use
TheraScope can assist with documentation, scheduling, billing, messaging, and reporting workflows. TheraScope does not provide medical, mental health, legal, tax, coding, insurance, or compliance advice. It does not make clinical decisions or emergency-response determinations. You remain solely responsible for professional judgment, record accuracy, required consents and notices, billing compliance, crisis protocols, and communications with patients, clients, payors, and regulators.
6. AI-assisted, transcription, and automation features
TheraScope may include AI-assisted and automation features that draft, summarize, classify, transcribe, transform, populate, search, or suggest information. Automated output may be incomplete, inaccurate, delayed, or unsuitable for certain patients, clients, jurisdictions, or contexts. You are responsible for reviewing, editing, approving, and using judgment before relying on any output.
7. Privacy, HIPAA, and Business Associate Agreements
If your use of TheraScope involves protected health information and you are a HIPAA-covered entity or business associate, you must have a signed Business Associate Agreement or other required data-protection agreement with us before using TheraScope for that information. These Terms of Use do not themselves create a Business Associate Agreement. You are responsible for applying your own notices, authorizations, consents, and minimum-necessary and retention obligations.
8. Acceptable use
- Do not use TheraScope to violate law, professional rules, or confidentiality obligations.
- Do not attempt unauthorized access to accounts, systems, data, or permissions.
- Do not interfere with, disrupt, reverse engineer, scrape, overload, or bypass TheraScope security.
- Do not upload malware, deceptive content, abusive content, or unlawful material.
- Do not send patient- or client-directed communications without lawful consent, notice, and opt-out controls.
9. Communications and patient messaging
TheraScope may support email, SMS, WhatsApp, portals, and other communication channels. You are responsible for recipient selection, message content, consent records, opt-out requests, quiet-hour policies, emergency escalation procedures, and platform-specific compliance requirements.
10. Subscriptions, payments, and billing
Paid functionality may require an active subscription or paid plan. Prices, plan features, trial availability, renewal terms, cancellation timing, payment obligations, and taxes may vary by plan and will be described at checkout, in the subscription management area, or another official confirmation document.
11. Third-party services and integrations
TheraScope may integrate with third-party services, including hosting, storage, authentication, calendars, email, SMS, WhatsApp, payments, transcription, AI, monitoring, support, and analytics providers. Your use of such integrations may also be governed by the third party's terms, privacy practices, and configuration requirements.
12. Intellectual property and feedback
TheraScope, including its software, interface, workflows, templates, documentation, trademarks, and service materials, is owned by us or our licensors and is protected by intellectual property law. These terms do not transfer any ownership rights in TheraScope. Feedback and suggestions you provide may be used by us to improve TheraScope, subject to our general product and IP policies.
13. Suspension, termination, and export
You may stop using TheraScope at any time. We may suspend or terminate access where required by law, for non-payment, or for security, legal, misuse, or repeated policy breach risks. Export, deletion, and retention after suspension or termination may depend on workspace settings, legal holds, backups, audit obligations, and signed agreements.
14. Service availability and changes
TheraScope is continuously improved and may be updated, modified, suspended, or discontinued in part. We strive for reliability, but do not guarantee uninterrupted, error-free operation or immunity from all threats.
15. Disclaimers and limitation of liability
To the fullest extent permitted by law, TheraScope is provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement as applicable. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, lost revenue, lost data, or business interruption.
16. Changes to these terms
We may revise these Terms of Use at any time. The most current version takes effect when posted. If we make material changes, we will update the last updated date and may provide additional notice where appropriate.
